1. Scope

These General Terms and Conditions (GTC) apply to all business relationships between ESKO.SWISS GmbH and its customers in connection with the offers and services of dachzeltshop.ch.

These terms and conditions apply in particular to:

the sale of roof tents
the sale of accessories
Awnings
roof rack
Camping equipment
the rental of roof tents and accessories
Assembly and service work
Orders via the online shop
Bookings and reservations

By placing an order, booking, reserving or using a service, these terms and conditions are deemed accepted.

3. Offer and conclusion of contract

The presentation of products and services on dachzeltshop.ch does not constitute a legally binding offer.

A contract is only concluded when:

with written confirmation,
with the shipment of the goods,
with successful reservation,
or at the start of the service.

ESKO.SWISS GmbH reserves the right to refuse orders or reservations without giving reasons.

4. Prices and means of payment

All prices are in Swiss francs (CHF) including statutory VAT.

The following payment methods are accepted:

credit card
Debit card
TWINT
Stripe
PayPal
Cash payment
Invoice (by arrangement)

ESKO.SWISS GmbH reserves the right to exclude certain payment methods.

5. Delivery and Shipping

Deliveries are made within Switzerland and Liechtenstein.

The flat shipping costs are CHF 250.–, unless otherwise agreed.

For deliveries to the European Union, an individual offer will be prepared.

Delivery dates are non-binding. Delivery delays due to force majeure, supply bottlenecks, or events beyond our control do not entitle us to compensation.

The risk passes to the customer upon handover of the goods to the transport service provider, to the extent permitted by law.

6. Purchase of products

The products offered may differ slightly in design, color or technical details from illustrations or descriptions.

ESKO.SWISS GmbH reserves the right to make technical changes, price changes and product range adjustments at any time.

The goods remain the property of ESKO.SWISS GmbH until full payment has been made.

7. Warranty and Guarantee

The statutory warranty rights apply in accordance with Swiss contract law.

The warranty period is generally 2 years from the date of purchase, unless otherwise stated for the respective product.

The following are specifically excluded from the warranty:

normal wear and tear
wear parts
improper use
Overloading
incorrect assembly by third parties
Damage caused by failure to comply with vehicle approvals or roof loads
Damage caused by improper transport or storage

Customers are obliged to check the correct roof load and the vehicle manufacturer's approvals themselves before use.

8. Returns and exchanges

Unused products can be returned within 10 days of receipt in their original packaging.

The following items are excluded from returns:

used products
individually configured products
Special orders
Reduced or sale items
Assembled products

The customer bears the cost of the return shipment.

9. Rental conditions for roof tents and accessories

rental period

The rental period begins with the handover of the rental equipment and ends with the agreed return.

When concluding a rental agreement, there is no entitlement to a specific model or version. ESKO.SWISS GmbH can provide equivalent or comparable models.

Subletting or passing on the rented goods to third parties free of charge is prohibited.

The rented goods remain the property of ESKO.SWISS GmbH for the entire rental period.

Condition of the rented goods

The rental equipment will be handed over in a tested and fully functional condition.

The customer agrees to handle the rented goods with care.

The roof tent and all accessories must be returned in a clean condition.

A cleaning fee will be charged for heavily soiled returns, depending on the effort required.

The hourly rate is CHF 120.– per hour.

Damage and loss

Customers are obligated to report damages or defects immediately to info@dachzelt-shop.ch to report.

ESKO.SWISS GmbH does not offer insurance for rental properties or customers. Customers are responsible for ensuring they have adequate insurance coverage.

The customer is fully liable for the following throughout the entire rental period:

damage
Loss
theft
improper use
Damage caused by third parties

Damage must be reported immediately.

Late return

If the return is late, reminder, processing and additional costs may be charged.

ESKO.SWISS GmbH is entitled, after an unsuccessful reminder, to invoice the rented goods in full at the current market value.

Additional rental and processing fees may be charged for late returns.

ESKO.SWISS GmbH reserves the right to invoice outstanding rental goods in full after the agreed return period has expired.

10. Reservation and Cancellation

A reservation becomes binding upon receipt of payment.

Upon receipt of payment, the reserved roof tent or accessories will be reserved for the agreed period.

Cancellation policy

Free cancellation up to 30 days before the start of the rental period.
Refund of 50% of the rental price up to 15 days before the start of the rental period
No refunds starting 5 days before the rental period begins.

Refunds will only be issued in the form of a voucher for dachzeltshop.ch.

External circumstances such as weather conditions, travel restrictions or official orders do not entitle you to a refund.

Unused rental periods do not entitle the renter to a refund.

11. Assembly service

Installations are generally carried out in the ESKO.SWISS GmbH showroom.

Installation at the customer's premises is possible by individual arrangement and for an additional charge.

The customer is obligated to:

to communicate the correct roof load
to check the vehicle approvals
to ensure the suitability of the vehicle

Use is at your own risk.

To the extent permitted by law, all liability is excluded.

12. Liability

The use of all products is at your own risk.

ESKO.SWISS GmbH is only liable for damages caused by gross negligence or intentional misconduct.

Any further liability is excluded to the extent permitted by law.

In particular, liability is excluded for:

indirect damages
Consequential damages
Usage losses
Travel interruptions
Damage due to incorrect vehicle information
Damage resulting from exceeding the roof load
Damage caused by improper installation or use

13. Data protection

Personal data is processed in accordance with our privacy policy.

14. Jurisdiction and applicable law

Swiss law applies exclusively.

The place of jurisdiction is Uster, Canton of Zurich.

Final Provisions

Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

ESKO.SWISS GmbH reserves the right to amend these terms and conditions at any time.

The version published at the time of the conclusion of the contract applies in each case.
